This class will discuss the relatively straightforward partition process, where one party wants to sell and the other does not. This does not relate to lot splits. Instead, partition lawsuits actually have much more relevance to today’s residential and commercial real estate markets, which can help Realtors sell more houses. The target audience is salespeople.


In fact, there are many California homeowners who feel locked into co-ownership with a sibling, an ex-partner, or a co-investor who doesn’t want to sell. Many of these people are being turned away by agents who don’t know how to help them. What’s more, co-ownership arrangements like these are on the rise, as more couples choose to buy homes together without being married. A clear understanding of the partition action process, and the liberation it offers, is essential in today’s real estate market.

Instructor Biography


Elijah Underwood is the founder of Underwood Law Firm, P.C., where the firm's focus is partition actions. Before founding the firm, Elijah was a partner at a prominent regional Sacramento firm. 


Elijah is a licensed real estate broker and lawyer who has represented congressmen and won jury and bench trials. His efforts have already changed state law in his decade-long legal career. Elijah is the instructor on partitions for the California Association of Realtors and sits on the Executive Committee of the Real Estate Section for the California Lawyer’s Association (formerly the State Bar Real Estate Section).

While in law school at the University of California, Hastings College of the Law, Elijah was a board-member for the award-winning Hasting Negotiation Team where he competed at the highest levels of national and international negotiation competitions. 


Elijah completed his bachelor's degree as a 2005 graduate of the University of California, Santa Barbara where he served in a leadership role in student government while also serving as the assistant to the Mayor of the City of Santa Barbara. 


During his legal career, Elijah Has been interviewed and quoted by television stations and publications, such as Newsweek, the L.A. Business Journal, C-Suite Quarterly, the Palm Springs Desert Sun, and KESQ. Elijah was previously a member of the Anthony M. Kennedy Inn of Court.
